Peach Privacy Policy
Applies to all users of the website.
1. General provisions
1.1. This Privacy Policy (the “Policy”) explains how the Administration of the Peach website (“we”, the “Site”, the “Administration”) collects, uses, stores and protects users’ personal data.
1.2. By visiting the Site, registering or using its services, you confirm that you have read, understood and agree to this Policy. If you do not agree with the Policy, please stop using the Site.
1.3. We act in accordance with the laws of Ukraine, in particular Article 32 of the Constitution of Ukraine, the Law of Ukraine “On Personal Data Protection” No. 2297-VI of 01.06.2010, the Laws of Ukraine “On Information”, “On Electronic Commerce”, “On Consumer Rights Protection”, and, where applicable, the EU General Data Protection Regulation (GDPR) for users from the European Union.
1.4. The controller and processor of personal data is the Administration of the Peach website. Data-related requests can be sent via the support form on the Site.
2. Purpose and nature of the Site (18+)
2.1. Peach is an online information platform (a classifieds board) intended solely for the convenient publishing, storage and search of advertisements by users. The Site acts as an information intermediary (an information hosting provider within the meaning of the Law of Ukraine “On Electronic Commerce”) and is not a party to any relationship that may arise between users.
2.2. The Site is intended exclusively for adults aged 18 or over. Before using the Site, every user confirms that they are of legal age. Persons under 18 are prohibited from using the Site.
2.3. The Site is NOT intended for offering, advertising, arranging, providing or obtaining services of a sexual nature, escort services, prostitution or any other services prohibited by the laws of Ukraine. The Administration does not act as a client, provider or intermediary in the provision of any such services.
2.4. The Site does NOT contain and does not allow the publication of pornographic material, material of a violent nature, material exploiting minors, or any other unlawful content. Publishing such content is strictly prohibited and results in the user being blocked.
2.5. The user who published an advertisement bears sole responsibility for its content, lawfulness, accuracy and legitimacy. The Administration does not control or guarantee users’ actions outside the Site.
2.6. The Administration reserves the right to moderate, reject or remove advertisements, to restrict or block access for users who violate this Policy, the Site Rules or the laws of Ukraine, and to share available information with competent authorities in the cases provided for by law.
3. What data we collect
We may collect the following categories of personal data:
- name or nickname (pseudonym);
- contact details: email address, messenger identifiers;
- phone number (including for confirmation via Telegram during verification);
- IP address, approximate geolocation, device and browser type;
- verification data: photos and other materials, if you voluntarily complete verification;
- payment data: transaction identifier, top-up confirmations (including cryptocurrency operations), balance history;
- technical information about your use of the Site (cookies, language and time-zone settings, behavioural data).
4. Legal bases and purposes of processing
4.1. We process personal data on the following legal bases: the data subject’s consent; performance of a contract (the Site’s terms of use); compliance with obligations imposed on us by law; and our legitimate interest in ensuring the security and proper operation of the Site.
4.2. We use your data solely to:
- identify the user and provide access to the account;
- publish, display and moderate advertisements;
- verify users and prevent fraud and abuse;
- confirm and verify payments and top-ups;
- provide user support (including handling support tickets);
- improve the operation, security and usability of the Site;
- protect the rights and legitimate interests of users and the Administration.
5. Sharing data with third parties
5.1. We do not share your personal data with third parties, except where:
- it is required by law or upon a lawful request of competent state authorities;
- it is necessary to enforce the Site Rules (in particular, in cases of fraud or abuse);
- you have given your explicit consent.
5.2. To operate the Site we engage service providers (processors), in particular hosting and cloud file-storage providers, email services and payment-processing services. Such providers process data solely on our instructions and are obliged to ensure an adequate level of protection.
5.3. Some data may be processed and stored on servers of service providers located outside Ukraine. In such cases we take measures to ensure an adequate level of data protection in line with the laws of Ukraine and, where applicable, the GDPR.
5.4. We do not sell, publish or disclose your personal data to advertisers, partners or other third parties for commercial purposes.
6. Data protection
6.1. We apply modern technical and organisational measures to protect your data, in particular:
- encryption of data in transit (HTTPS/TLS);
- access to personal data restricted on a need-to-know basis;
- internal control and access-logging systems.
6.2. Materials provided for verification are not made publicly available, are not indexed by search engines and are not used outside your interaction with the Site.
7. Cookies
7.1. We may use cookies and similar technologies to:
- maintain sessions and authentication state;
- store user preferences (language, time zone, age confirmation);
- analyse usage and improve the convenience of the Site.
7.2. You can limit or disable cookies in your browser settings; this may affect the availability of certain Site features.
8. Data retention
8.1. The retention period of your data depends on the nature of its use:
- core account data is stored until the account is deleted;
- payment data — until the relevant checks are completed and for the periods set by law;
- verification materials — until a decision on access is made, but no longer than 30 days.
8.2. Once the retention periods expire, data is deleted or anonymised, unless otherwise required by law.
9. Your rights
In accordance with the Law of Ukraine “On Personal Data Protection”, you have the right to:
- receive information about, and access to, the processing of your personal data;
- request correction, updating or deletion of your data;
- withdraw previously given consent to processing (this may limit access to certain Site features);
- object to processing and request its restriction in the cases provided for by law;
- file a complaint with the Ukrainian Parliament Commissioner for Human Rights or with a court.
10. Protection of minors
10.1. The Site is not intended for persons under 18, and we do not knowingly collect the personal data of such persons. If we learn that data was provided by a person under 18, such data will be deleted and the account blocked.
11. Liability
11.1. The Administration is not liable for a data breach caused by the actions of third parties or malicious actors, or by the user’s failure to observe basic security measures (in particular, not disclosing account access credentials).
11.2. The Administration is not liable for the content of advertisements, the acts or omissions of users, or relationships arising between users outside the Site.
11.3. All requests related to the processing of personal data can be sent via the support form on the Site.
12. Changes to the Policy
12.1. We may update this Policy from time to time. The current version is always available on the Site, indicating the date of the last update. Continued use of the Site after changes are made constitutes your acceptance of the updated Policy.
